TERMS AND CONDITIONS OF THE ONLINE STORE

The owner of the online store is Wiślanka sp. z o. o./Malinka 41C, 43-460 Wisła/ NIP: 548-266-80-86/ REGON: 243701020. The Regulations are addressed to the Customers using the service of purchase in the online store www.wislanka.pl.

BASIC INFORMATION

The Rules and Regulations were created for safe buying and selling, protecting both the Client and the Seller.

Client – a person purchasing material goods from the Seller for a fee.

Seller – Wiślanka sp. z o. o., offers material goods to Customers for a fee.

Store – online store at www.wislanka.pl.

The Seller offers food products. When entering the store’s website, the Client is obliged to acknowledge the type of products offered.

It is possible to create a free customer account, where the customer’s data, preferred payment method and purchase history will be stored. The data contained in the customer’s account is confidential and used only for the purpose of a proper buying and selling process.

You do not need to create a free customer account to make a purchase.

The ordering process is completely electronic and done on the store’s website.The ordering process is completely electronic.

The customer, by finalizing the purchase, agrees to receive information regarding the execution of the order electronically.

PROCESSING TIME

Order processing time up to 5 working days. The lead time may be extended, of which the customer will be informed by e-mail.

PAYMENT

The customer can pay by cash on delivery(only in Poland via INSPOT) or by using Paynow online payment gateway.

SHIPMENT OF ORDERED GOODS

Shipping is offered on the territory of the Republic of Poland. The seller offers shipping via INPOST courier and parcel machines.

Shipping outside of Poland is via DHL Group.

  • For now the shipping outside of Poland regards only Germany.

Cost of shipping via INPOST:

  • The cost of shipping by standard courier and to a parcel machine is 15 PLN, regardless of the size of the order.
  • The cost of shipping by COD courier is 20 PLN. Shipping by cash on delivery courier must be confirmed by phone or e-mail. The seller calls for confirmation or writes an e-mail. The seller does not send the shipment until he receives the confirmation. Unconfirmed shipment is canceled 7 days after the order is placed. The seller may extend the waiting time for confirmation.

Cost of shipping via DHL Group:

  • The cost of shipping by standard courier is 35 PLN, regardless of the size of the order.

The shipping cost is paid by the customer.

The cost of shipping may vary overtime.

RODO

The administrator of personal data is Wiślanka sp. z o. o./Malinka 41C, 43-460 Wisła/ NIP: 548-266-80-86/ REGON: 243701020.

The customer’s data is processed in order to properly go through the process of purchase, sale and shipment, and to create a free customer account, which stores the data for use for repeat purchase by the customer.

The data is shared with the courier company INPOST for delivery of the purchased goods.

The data is processed from the start of the order until the courier company delivers the goods.

The customer has the right to request access to the data or their deletion. For this purpose, you need to contact marketing@wislanka.pl by e-mail.

CANCELLATION

The customer has the right to cancel the order within 14 days without giving any reason, provided that the product has not been shipped.

In order to exercise the right to cancel the contract, the customer must inform the Seller of his decision by making a clear statement.

You can inform the Seller of your decision by e-mail to marketing@wislanka.pl.

Reimbursement will be made no later than 14 days from the date of receipt of the statement regarding cancellation by e-mail. The same payment method that was used by the Customer to place the order will be used, and the Customer will not incur any fees for such refund.

COMPLAINT

The basis for making a complaint about a product is to notify the seller of the non-conformity of the goods with the contract. In this case, the Client is obliged to:

– notify the Seller of any non-conformity immediately after opening the packaged product, but no later than within 3 days of opening (OJ of 2003, No. 31, item 258).

– Notification of non-conformity of the goods before the expiration date.

The Seller reserves the right to refuse to accept the advertised goods that do not have the non-conformities mentioned by the Client. The Seller shall decide whether to accept the complaint at its sole discretion.

RETURN

The Seller has food products on the site, with a short shelf life, so they are not subject to return, the Client agrees to these conditions by paying for the order.

The following goods are not eligible for return(Article 38 point 4 of the Law on Consumer Rights):

Goods made to order or strictly personalized.

Goods that, due to their nature, cannot be returned, such as goods that spoil quickly or whose expiration date has passed.

Goods that are not returnable for health or hygiene safety reasons and have been unpacked after delivery.

Goods which, after delivery, according to their nature, will be inseparably connected with other items.

SHIPMENT OF NON-CONFORMING GOODS

The Client shall be responsible for the cost and risk of returning the goods to the Seller. The goods should be sent to the following address:

The Seller is not responsible for goods damaged or lost during return shipping. Therefore, it recommends the use of insurance and postal tracking service. The seller cannot make a refund if the seller does not receive the goods or confirmation of receipt by the seller of the return shipment.

In matters not covered by these Terms and Conditions, the provisions of Polish law, in particular the Civil Code and the provisions of the Act on Special Terms of Consumer Sales and Amendments to the Civil Code of July 18, 2002 (Journal of Laws 2001 No. 144 item 1204) the provisions of the Consumer Rights Act of May 30, 2014 shall apply. (Journal of Laws 2014, item 827, as amended); and other relevant provisions of common law.
